Bluestone

A Reckoning in North Birmingham as EPA Studies the ‘Cumulative Impacts’ of Pollution and Racism

With the EPA review ongoing at the 35th Avenue Superfund site, the Southern Environmental Law Center on Friday threatened new federal litigation against Bluestone Coke for alleged wastewater pollution.

 In 2018, a smokestack on the site of then-ERP Coke, within the EPA's 35th Avenue Superfund site in north Birmingham, Alabama. The facility was sold in 2019 to the family of West Virginia Gov. Jim Justice, and is now called Bluestone Coke. The facility temporarily ceased operations in 2021, but still owes the Jefferson County Health Department almost $300,000 in fines and penalties for air pollution violations.
