New York’s Green Amendment Would Be ‘Toothless’ if a Lawsuit Is Tossed Against the Seneca Meadows Landfill for Allegedly Emitting Noxious Odors
AG Letitia James has urged a state court to dismiss the suit against Seneca Meadows, in which plaintiffs invoked their rights under the Green Amendment to “clean air.” As precedent, she cited an appellate court’s recent dismissal of another Green Amendment suit against the High Acres landfill in Fairport.
