In Pennsylvania’s Primary Election, Little Enthusiasm for the Northeast’s Regional Greenhouse Gas Initiative

While Gov. Tom Wolf, a Democrat, has moved to become part of RGGI, even the Democratic candidate running to replace him is non-committal.

Pennsylvania became the first major fossil fuel-producing state to agree to put a price on carbon last month, when Gov. Tom Wolf’s administration finalized rules to join 11 other states in the northeastern Regional Greenhouse Gas Initiative (RGGI).

But it remains to be seen whether Wolf, a Democrat who is winding down his eight-year term in office, is leaving behind a lasting legacy for climate action, or a last-gasp effort that will be swept aside by foes or one of his would-be successors running in Tuesday’s primary—even one from his own party. 

Under RGGI’s “cap-and-invest” design, states agree to set a cap on emissions from their power sectors that declines each year, currently at the rate of 3 percent annually. Power generators buy “allowances” at periodic auctions for each ton of carbon they will emit, with proceeds going to the states to assist in their transition to clean energy. 

Because Pennsylvania currently generates more than double the coal power of all other RGGI states combined, its emissions allowances initially will be set at a high level—76 million tons of carbon. With the price of carbon recently reaching a record $13.50 per ton in the RGGI market, Pennsylvania could garner more than $1 billion in its first year, exceeding the total proceeds brought in by nearly any other RGGI state over the 13 years of the program.

In addition to bringing in revenue, the price is designed to nudge power generators toward choosing carbon-free fuels instead of paying for allowances to emit carbon. 

The coal and power industry, labor groups and an agency of the Republican legislature are all in court seeking to block Pennsylvania from joining RGGI. The litigation could delay implementation until the next governor takes office. And as Pennsylvania’s May 17 primary election approaches, it is clear that none of the candidates to replace Wolf—Democratic or Republican—are fans of RGGI. In a state second only to Texas in natural gas production, there is bipartisan skepticism of any policy that could put a damper on fracking.

Pennsylvania’s laborious effort to join RGGI, and the precarious future of its membership in the emissions-cutting club, illustrates the tremendous political pressure that has worked against the multi-state pact throughout its 13-year effort to lower greenhouse gas emissions from electricity. The fossil fuel industry and its allies have fought the program relentlessly, painting it as a hidden energy tax (despite evidence that electricity customers in the region have saved more than $1 billion on their bills). Member states have come and gone as leadership of state capitals changed hands. 

Big Power Player Joins Regional Climate Pact

Even so, RGGI has had success: Carbon emissions from power plants have been cut 44 percent in the nine states that have participated in RGGI since the beginning, an effect scientists concluded was largely driven by the program. Participating states, meanwhile, have garnered nearly $5 billion in revenue, money they’ve invested in energy efficiency and clean energy projects, assistance to low-income ratepayers and projects to address climate impacts.

Pennsylvania could take in more than $1 billion its first year in the program, while getting on track to reduce up to 225 million tons of carbon pollution by 2030. 

“This regulation has the support of businesses and residents, and will save lives and millions of dollars by cutting air pollution,” said Patrick McDonnell, secretary of Pennsylvania’s Department of Environmental Protection, in announcing the final rules. And in words that have an ominous ring, given the legal and political hurdles RGGI still faces in the state, he added, “While Pennsylvania cannot singlehandedly solve the global climate crisis, the world cannot solve the crisis without Pennsylvania.”

Wolf’s RGGI War With the Legislature

Wolf talked about joining RGGI when he first ran for governor in 2014, but it was not a priority during his first term in office, which was marked by brutal budget battles with the Republican-controlled legislature. He was never able to gain traction for his proposal to impose a severance tax on natural gas extraction, which has grown over the past decade to be a major industry in the state thanks to fracking in a large geological formation beneath the Appalachian Mountains, the Marcellus Shale. Pennsylvania is the only major oil and gas producing state without a severance tax. (Instead, drillers pay a smaller impact fee, which mainly goes to county governments.)

After Wolf won reelection in 2018, he launched his drive for Pennsylvania to join RGGI, as the centerpiece of his climate program for the state. But Pennsylvania’s GOP legislature warred with Wolf over RGGI, repeatedly passing laws designed to block the state’s participation—measures that in turn were vetoed by Wolf.

“We’ve got a very recalcitrant, climate-denying fossil-friendly legislature in Pennsylvania,” said Jackson Morris, director of the Natural Resource Defense Council’s eastern region climate and clean energy program. “The legislature has exhausted every parliamentary stunt that they have, and they just don’t have the votes to override the veto from the governor.” 

While other RGGI states passed new laws enabling their entry into the program, Wolf’s administration used Pennsylvania’s existing environmental laws to design a plan for the state’s entry into the program. The state DEP held 10 public hearings and garnered 14,000 public comments on the plan. Based on its analysis of the information it had gathered, the Wolf administration projected that participation in RGGI would increase Pennsylvania’s Gross State Product by nearly $2 billion, and result in a net increase of 30,000 jobs by 2030.

A Clean Energy Windfall

Even though Pennsylvania has not been a part of RGGI, carbon emissions from electricity in the state have fallen a third since 2009. The market has been prodding the industry in the direction of cleaner energy, because coal is more expensive than the alternatives. The most recent modeling by the state DEP shows that with or without RGGI, all of Pennsylvania’s remaining conventional coal plants are uneconomic and likely to close by 2025. That means the biggest change that RGGI’s price on carbon is likely to spur in the Pennsylvania power sector is a switch from natural gas to carbon-free alternatives—renewable energy and the state’s existing nuclear power fleet, as well as energy efficiency.

“Joining RGGI is, hands down, the most significant climate policy action taken in Pennsylvania’s history,” said Morris. 

But natural gas, which now fuels more than half of Pennsylvania’s electricity, is a business with political allies in both parties.

Even the Democrat Is Lukewarm on RGGI 

The front-runner among the eight Republicans running for governor is a hard-line RGGI foe, State Sen. Doug Mastriano, who is perhaps better known for his avid support of former President Donald Trump’s efforts to overturn the 2020 election. Not only did Mastriano organize an ad-hoc hearing in Gettysburg to scrutinize the Pennsylvania election results after they had been certified by the state and upheld in the courts, but he paid for buses to transport a Pennsylvania contingent to the Jan. 6, 2021 rally that devolved into a siege on the Capitol. Mastriano, who has said he departed before the protest turned violent, has been subpoenaed by the Congressional investigating committee.

Mastriano is equally brash in his critique of RGGI, which he has described as a threat to national security as well as Pennsylvania’s economy and energy independence. The other RGGI states “do not come close to the number of electricity production facilities we have here in Pennsylvania,” he said. “Pennsylvania is an energy powerhouse.” 

There is little doubt that Mastriano would seek to block or reverse Pennsylvania’s entrance into the multi-state pact. In fact, he has promised to expand gas drilling substantially if elected: “Fracking like you wouldn’t believe,” he said at a recent candidates’ forum. But even Republican party officials believe that he would be a weak candidate if he wins next week’s primary, and reportedly have been trying to join forces to block his nomination.

Meanwhile, Pennsylvania Democrats already have united behind state Attorney General Josh Shapiro, who is running unopposed in the gubernatorial primary. Shapiro will have an advantage in November in the statewide election, with Democrats outnumbering Republicans in voter registrations by 550,000 voters, or six percentage points.

But Shapiro has been lukewarm about RGGI. On a campaign stop late last year in Indiana County in rural western Pennsylvania, a locale with three coal power plants, he said he was worried about RGGI’s potential economic impact. “I understand the aims of RGGI, and the goals,” Shapiro told The Indiana Gazette. “I have real concerns about the impact it will have on consumer prices, hurting families at a time when many are struggling really to put food on the table.”

When pressed on whether he would pull Pennsylvania out of RGGI if elected, Shapiro has made no commitment, but voiced support for a program of clean energy investments without capping emissions or forcing polluters to pay. “Ultimately, that is a determination I will make as governor, in close consultation with workers and affected communities,” Shapiro said in a statement to the Pennsylvania Capital-Star newspaper. “I refuse to accept the false choice between protecting jobs or protecting our planet—we must do both and my priority will be ensuring Pennsylvania has a comprehensive climate and energy policy that will move all of us forward.” 

Shapiro has refused to endorse any restrictions on natural gas drilling in Pennsylvania, saying that he supports “making sure we have responsible fracking in the commonwealth.” As attorney general, he has pursued high-profile criminal cases against fracking companies for violations of environmental law. And despite his reservations about RGGI, he gave the Wolf administration the needed legal approval for its plan to join the program. 

How Shapiro would treat RGGI if elected remains a question mark; if the court challenges against Pennsylvania’s entry into the program should succeed, the decision will be squarely in his lap if he is elected.

The Pennsylvania Coal Alliance, coal power generators, the United Mineworkers Union and two other trade unions are asking a state court to block Wolf’s RGGI plan. The state’s biggest business groups also are opposed, with Carl Marrara, top lobbyist for the Pennsylvania Manufacturers’ Association, saying it is “not a stretch” to say supporting RGGI is supporting Russian and Middle Eastern global energy leadership and Chinese steel dumping. 

But polls shows that 60 percent of Pennsylvanians support joining RGGI, as do a number of businesses, like the nuclear power giant, Exelon, energy efficiency companies Schneider Electric and Lutron, and an array of entrepreneurial firms who believe participation in RGGI will support development of a clean energy industry in the state. They argue it would be a more sustainable economic pathway for Pennsylvania than natural gas, which did boost GDP in the state, but in a way that did not translate to job creation, education or other benefits to ordinary Pennsylvanians, according to several studies.

Ultimately, Pennsylvania politics will decide whether or not RGGI sees its largest expansion since its inception. The uncertainty is nothing new for RGGI. New Jersey left the program, then returned, when the governor’s office changed hands. And now RGGI faces the possible defection of Virginia, only a year after it joined the initiative, after the election of Republican Gov. Glenn Youngkin. 

Meanwhile, North Carolina’s environmental regulators are working on a rulemaking to bring that state into the RGGI program. As in Pennsylvania, a Democratic chief executive, Gov. Roy Cooper, has been fighting the GOP legislature over his ambitious climate plan. If North Carolina joined, it would be second only to Pennsylvania in the amount of coal-fired power it would bring into the carbon-cutting program.

Bruce Ho, senior climate and clean energy advocate for the Natural Resources Defense Council, said that RGGI will never be a replacement for national level climate action, but it has demonstrated how much states can do to cut carbon emissions through cooperation. “The fact that RGGI is an effective, flexible and adaptable program that enables new states to join is a big deal,” Ho said. 

Just how effective RGGI can continue to be will depend on whether it can bring fossil fuel states like Pennsylvania into the fold.

“I think that to continue to expand RGGI is critical,” Ho said. “And that was always the original intent of the program, to kind of start with this core group and then expand outward to have a greater impact on the climate.”
